In 1939, President Roosevelt attempted to assert more control over the process by transferring the BOB from the Treasury Department to the White House to provide him with even greater control over budget making. In 1970, President Nixon renamed BOB the Office of Management and Budget (OMB) and expanded its powers. The OMB's primary duties are to prepare the federal budget for the next year and monitor the budget's execution for the current fiscal year, which runs from 1 October to 30 September.

More recent decisions have enhanced government's power to regulate the economy. However, for its first 150 years through the 1940s, the Supreme Court tended to interpret the Constitution very narrowly and literally. It ruled illegal dozens of laws that increased the government's ability to manage the economy and specific sectors. In contrast, the Warren and Burger Courts of the 1950s through the 1970s were criticized for "judicial legislation" or making policy rather than simply ruling on whether or not an existing law was constitutional.
